## Why Act Immediately on an Objection?

A trademark objection is not a rejection — it is an opportunity to respond and save your application. But the window is strict.

01

### 30-Day Hard Deadline

The Trademark Registry gives exactly 30 days to file a reply. No extension is available. Miss it and your application is treated as abandoned.

02

### Protect Fees Already Paid

Government filing fees (₹4,500–9,000 per class) are non-refundable. A well-drafted reply protects that investment from going to waste.

03

### Technical Legal Arguments

Objections require structured legal arguments — citing distinctiveness, prior use, disclaimers, or differences from cited marks. A non-expert reply often fails.

04

### Stop Competitors First

Until your mark is registered, competitors can file identical or similar marks. Resolving the objection quickly closes this gap.

## Legal Framework

Objections are raised by the Trademark Examiner after scrutiny of the application under the Trade Marks Act 1999.

**Trade Marks Act 1999, Section 9 (Absolute Grounds for Refusal):** Marks that are devoid of distinctive character, descriptive of goods/services, or contrary to public policy cannot be registered. A reply must demonstrate why the mark does not fall under these grounds — or has acquired distinctiveness through use.

**Section 11 (Relative Grounds for Refusal):** If an identical or deceptively similar mark already exists in the same class, the examiner will cite it. The reply must argue why confusion is unlikely — based on differences in appearance, phonetics, goods/services, or trade channels.

**Rule 45, Trade Marks Rules 2017:** The applicant must file the reply within 30 days of receiving the examination report. If no reply is filed, the application is deemed abandoned.

## Our Process

We review your objection, build the legal arguments, and file the reply — all within 5–7 days.

1

### Review Examination Report

We analyse the grounds of objection — whether absolute (Section 9), relative (Section 11), or both — and identify the appropriate legal response strategy.

2

### Research Conflicting Marks (if relative ground)

If a prior mark is cited, we analyse differences in appearance, phonetics, meaning, and trade channels to argue against likelihood of confusion.

3

### Build Distinctiveness Arguments (if absolute ground)

We prepare arguments on acquired distinctiveness through use, attach evidence of brand use (invoices, ads, website), and draft appropriate disclaimers if needed.

4

### Draft and Review Reply

Complete reply drafted with all legal arguments and supporting evidence. Shared with you for review before filing.

5

### File on IP India Portal

Reply filed on the IP India portal within the 30-day deadline. Filing acknowledgement shared with you immediately.
